Preamble

These Terms and Conditions of Use (hereinafter the "Terms") govern the relationship between everwinner64 (hereinafter the "Publisher") and any individual or legal entity using the website Ultimate Chess (hereinafter the "Site"). Access to the Site implies full and unconditional acceptance of these Terms by the User.

Article 1 – Definitions

For the purposes of these Terms, the following definitions apply:

User: any person who accesses and uses the Site, for any purpose (gameplay, file import/export, settings, etc.).

Service(s): the functionalities provided by the Site, including but not limited to: local chess gameplay, file import/export, settings customization, and donations via Ko-fi.

Source Code: the software instructions, algorithms, scripts, and internal structures of the Site, whether front-end, back-end, or any technical component.

User Data: any files or content imported or generated by the User while using the Site.

Donation: a voluntary financial contribution made by the User through the Ko-fi platform.

Article 2 – Purpose

These Terms define the conditions under which the Publisher provides the Site and Services, and the conditions under which the User uses them. They specify the rights and obligations of both parties as well as limitations of liability.

Article 3 – Acceptance and Entry into Force

Use of the Site constitutes unconditional acceptance of these Terms.
These Terms take effect upon publication on the Site.
The Publisher reserves the right to modify these Terms at any time. Modifications take effect once published, and Users are encouraged to consult the current version regularly.

Article 4 – Access to the Site and Services

The Site is accessible free of charge to any User with an internet connection.
No user account is required to access the Services.
No online multiplayer services are provided; only local play and file import/export are available.
The User may adjust certain settings and parameters, within the limits set by the Publisher.

Article 5 – Use of the Site

The User may import or export chess game files in formats supported by the Site.
The Publisher does not guarantee compatibility with all external file formats.
The User is responsible for safeguarding their own files; the Publisher shall not be held liable for any data loss related to import, export, or local storage.

Article 7 – Settings

The User may adjust certain Site settings (e.g., theme, layout, gameplay options) as provided by the interface.
These adjustments are made at the User’s own risk; the Publisher does not guarantee that all settings will function identically across devices, browsers, or operating systems.

Article 8 – Donations

The User may, if they wish, make a Donation via Ko-fi.
Donations are voluntary, non-obligatory, non-refundable, and do not grant the User any particular rights, advantages, or influence over the Site’s content, development, or decisions.
Payment processing and security of donations are governed by Ko-fi's terms, including matters of liability and taxation.

Article 9 – Intellectual Property

The Site, its content, visuals, logos, interface, databases, and source code are the exclusive property of the Publisher or its rights holders.
Any reproduction, representation, modification, adaptation, translation, publication, transmission, use, or exploitation, in whole or in part, of the Site, the Source Code, or its elements, by any means whatsoever, without the Publisher’s express written consent, is prohibited.
Certain third-party assets (such as images, icons, fonts, software libraries, etc.) remain the exclusive property of their respective authors and are used in accordance with their licenses. The Publisher does not claim any intellectual property rights over these elements, which are credited where applicable.

Article 10 – User Suggestions and Contributions

The User may provide the Publisher with suggestions, ideas, feedback, or proposals for improving the Site.
Such contributions are submitted voluntarily and free of charge.
The Publisher is free to use, reproduce, modify, implement, or distribute these contributions without any obligation to notify, seek authorization from, or compensate the User in any way.
The User expressly waives any claim of rights or royalties related to the use of their suggestions.

Article 11 – Liability and Warranties

11.1 No Warranty

The Site and Services are provided “as is” and “as available,” without any express or implied warranties of any kind.
The Publisher does not guarantee that the Site will be uninterrupted, bug-free, error-free, or fit for a particular purpose.

11.2 Limitation of Liability

In no event shall the Publisher be held liable for direct or indirect damages, material or immaterial, foreseeable or unforeseeable, resulting from the use or inability to use the Site, including but not limited to: data loss, file loss, loss of profit, or loss of opportunity.
The Publisher shall not be held liable for service interruptions or issues caused by third-party providers such as Cloudflare or Ko-fi.
The Publisher’s liability shall in all cases be limited to the amount of any donation received, if applicable, relating to the claim or damage giving rise to liability.

Article 12 – Duration, Suspension, Termination

These Terms apply for the duration of the User’s use of the Site.
The Publisher reserves the right to suspend or terminate access to the Site, temporarily or permanently, including for maintenance, updates, or force majeure, without the User being entitled to compensation.

Article 13 – Personal Data

The Publisher is committed to respecting the User’s privacy.
When the User voluntarily provides personal information via the contact form (such as name, email address, or other details), this information is collected solely for the purpose of enabling the Publisher to respond to the User’s request.
These data are not sold or shared with third parties.
They are retained only for the time necessary to process the request.

Article 14 – Severability

If any provision of these Terms is found to be null or unenforceable under applicable law or by a final decision of a competent court, the remaining provisions shall remain in full force and effect.

Article 15 – Applicable law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of laws principles.


The Ultimate Chess site is independent and has no connection, partnership, or affiliation with other websites, applications, or services bearing the same or a similar name.
